A spokeswoman for Gov. Kevin Stitt said he did not sign Senate Bill 1081, which would prevent Oklahoma cities from implementing a „red flag“ gun policy. An error on the website of the state legislature seemed to indicate otherwise. Stitt has until Thursday to sign the bill or veto it. But gun rights activists do not agree with this argument. Red flag laws ignore due process, said F. Paul Valone, president of Grass Roots North Carolina. It rejects provisions in red flag laws designed to be used in a crisis that allow judges to confiscate firearms after an emergency hearing without giving gun owners the opportunity to defend themselves. However, firearms owners generally reserve the right to receive a full hearing within a few days of the first order. More than a dozen states across the country have passed red alert laws that allow police or family members to temporarily remove guns from vulnerable people who may pose a violent threat to themselves or others. A 2018 study published in the journal Psychiatric Services used CDC data from all suicides in all 50 states from 1981 to 2015 to „examine the impact of the Connecticut and Indiana Risk-Based Firearms Seizure Act on statewide gun suicide rates.“  The researchers concluded that „Indiana`s Firearms Seizures Act in the decade following its passage was associated with a 7.5% reduction in gun suicides, an effect specific to gun suicides and greater than that of any random comparison state only.
After several mass shootings this spring, President Biden has called on Congress to pass legislation to reduce gun violence, including a red flag law — also known as the Extreme Risk Protection Order — at the federal level and laws that incentivize states to pass their own. In June, the Justice Department released model legislation to help states create their own alert laws. Red flag laws are also called risk-based gun withdrawal laws and have several names: Wisconsin residents appear to overwhelmingly support the measure. A 2019 Marquette University poll found that 81 percent of respondents were in favor of passing a red flag law. Public opinion continues to give gun safety advocates like Jeri Bonavia, executive director of the Wisconsin Anti-Violence Effort Educational Fund, hope that badger state could one day pass this law. „The idea of keeping guns out of the hands of dangerous and unstable people is a good idea until you look at the basics of implementation,“ said Valone, who strongly opposed a Red Flag law in North Carolina. The bill will not be the subject of a committee hearing or passed by the legislature, Republican lawmakers told him. The Rhode Island ACLU opposed such a law, stating that „people who are not accused of committing a crime should not be subject to severe deprivation of liberty. in the absence of a clear, convincing and immediate demonstration of necessity. As well-intentioned as this law is, its breadth and light standards for the application and granting of an ERPO are of great concern.  As of April 2020, 19 states and the District of Columbia had enacted red flag legislation.
States that have added Red Flag legislation since 2018 include: California Democratic Senator Dianne Feinstein introduced a bill, the Extreme Risk Protection Order Act (p. 506), that would allow states to use subsidies to craft red flag laws. The legislature is supported by 25 Democratic senators and two Democratic-oriented independent senators.   Senator Marco Rubio, a Republican from Florida, introduced a separate bipartisan bill that would use grants to encourage the passage of state red flag laws.  Senator Lindsey Graham, a Republican from South Carolina, said in 2019 that he also plans to introduce legislation to encourage states to pass red flag laws.
